Information about the collection, processing and use of your data (General Data Protection Terms)

Please note that the Special Data Protection Terms apply in addition, if you have explicitly given consent while registering for a service.

The trust you place in us to handle your data properly is an important condition for the success of our online service. We therefore place great importance on data protection. The collection, processing (including storing, amending, transmitting, blocking and deleting) and use of your data is carried out exclusively in compliance with the applicable data protection regulations.

We would like to briefly outline our principles concerning the collection, processing and use of your data:

1. Collection, processing and use of personal data

Personal data is information regarding the identity of an individual, such as name, address, date of birth or e-mail address.

1.1. During general use of our online service

Principally, none of your personal data is collected, processed and/or used throughout the use of this online service.

1.2. When requesting specific services

Personal data is collected, however, when it is provided to us of your own accord. We then process and use this data if it is necessary to provide the service that has been requested.

Below you can find a few examples in which we collect, store and use personal data:

• Contests

If you decide to take part in a contest that we have organised, we will ask you to provide us with your name, your date of birth, your e-mail address, your telephone number and/or your postal address, above all so that we can inform you in case you win, but also to ensure that each participant only enters the contest once.

• Subscribing to offers/information (e.g. by newsletter)

As part of our online service, we offer you the opportunity to receive updates on interesting offers and news from us by various media (e-mail, telephone and/or SMS/MMS). If you add your name to our newsletter distribution list, for instance, the requested newsletter will be sent regularly to your e-mail address. You can remove your name from the distribution list at any time. We will then refrain from contacting you. When registering for the newsletter, you may also have the opportunity to provide further details about yourself, if you would like to receive a birthday surprise, for example. We will process and use the data that you provide us with for these purposes.

• Personalised services

Should you wish to take advantage of services which require registration, we will collect, process and use the data that is necessary to provide these services to you.

2. Collection, processing and use of usage data

Usage data is data that you do not actively provide but that may be passively collected while you are browsing a website, for instance. After a visit to our website we store the following data for four (4) working days: the domain name or the IP address of the enquiring computer, the client’s file inquiry (file name and URL), the HTTP response code, the Internet site from which you are visiting us, as well as the date and the duration of your visit. This data is stored to determine disruptions or abuse of our online service and of our telecommunication services/systems, provided the data is required to establish further connections and/or for accounting purposes. Usage data is not evaluated to create a personal user profile unless you have specifically consented to such use. In the case of disruptions or abuse, we reserve the right to report this to a law enforcement agency. There is no further use or disclosure of your usage data to third parties.

3. Use of cookies

• What are cookies?


A cookie is a small text file sent by web servers when an internet site is visited and is stored on the hard drive of the respective user. If the relevant server is contacted again, the user’s browser sends the previously received cookie back to the server. The server can then interpret the information received through this procedure in different ways. For example, cookies are used to control pop-up ads or to make it easier to navigation through a website.

• How does SIM use cookies?

During a user’s visit to one of our online service site, cookies are sent to the user’s browser and stored on the user’s hard drive. These cookies make our online service more user-friendly, more effective and more secure. The cookies do not contain any personal data or any personal information about you, so that it is not possible for us to identify you using the information received via cookies. The information received is used exclusively for the purpose of generating statistics on the use of our online service. In this way we can adapt our online service to your requirements and make surfing on our site as convenient as possible.

Another reason cookies are used, for example, is so that you can see the contents of your shopping basket across different web pages, or to control the supply of pop-up ads.

If you enable auto login, a cookie containing your registration data is sent from the relevant page of our online service so that you are recognised the next time you use the site and you do not have to log in again. You can deactivate the auto login at any time after it has been enabled.

If you do not want to take advantage of the benefits of cookies, our online service can also be utilised without cookies, of course. Every web browser can be configured to reject cookies across the board.

If you choose to configure your browser to reject cookies, you may no longer be able to take full advantage of all the services and/or functions of our site.

• How do third parties use cookies and so-called "web beacons" on our site?

Our online service uses Google AdSense, a web service offered by Google Inc., USA ("Google"), which places third-party advertisements ("adverts") on our online service. We would therefore like to make you aware that through these adverts Google may place and read cookies on your browser and may use "web beacons" (small invisible graphic files) to collect information. The information generated by these cookies and/or web beacons is transferred to a Google server in the USA and processed there.

The use of the so-called DoubleClick DART cookies enable Google to use information about your visits to our online service to activate adverts that might interest you (interest-based advertising). You can deactivate the use of Double Click DART cookies on the Google website (www.google.com) by clicking on the "Advertising" policy in the Google "Privacy Centre" and following the instructions there regarding deactivation.

You can also prevent Google cookies from being set by configuring your browser accordingly. Should you configure your browser for this purpose, you may no longer be able to take full advantage of all the services and/or functions of our site.

4. Disclosure of your data

Your data is not disclosed to our business partners or other third parties, unless

• You have specifically given consent.

• A third party proves to us that you have violated its rights by placing content (texts, images etc.) on our web site, and demands the release of your data.

• We are obliged to release this data, for example, on the basis of a court order or at the instruction of public authorities.

5. Changes to your data

We make every effort to ensure that your personal data is stored accurately. However, you may change (i.e. update, correct and/or amend) or delete your data at any time in the user profile area of the relevant service. To protect your privacy and your security, we verify your identity before you are allowed carry out such actions.

6. Cancellation option

If you are no longer interested in receiving certain information or offers, or no longer wish to receive the information/offers via a certain media, please let us know by sending an e-mail to the e-mail address below. We will deal with your request promptly. You can also contact us at the same address if you wish to withdraw your consent for any future collection, processing and usage of your data. In this case, we will immediately delete all of your stored data. 7. No liability for Internet sites of partners

Our web pages contain links to various business partners who offer their own Internet sites and services. They usually have their own data protection policies. We assume no liability for these policies, with which we have no connection. Please consult the respective data protection policy directly at those sites.

8. Data security

We feel responsible for the security of your data. To prevent unauthorised access or disclosure, and to ensure accuracy and legitimate use of the data, we have introduced appropriate technical and organisational procedures to secure and protect the data we request online. However, we cannot accept responsibility or liability for the disclosure of your data due to errors during data transmission and/or unauthorised third party access.

10. Amendment of Data Protection Terms

We reserve the right to amend these General Data Protection Terms in line with the current data protection laws. The General Data Protection Terms available online at the time of your visit applies to the use of our online service.

If you have provided us with personal data when using a specific service, we will notify you of any changes to these trms by appropriate means (e.g. by e-mail) no later than four weeks before they come into effect. If you do not contest these changes within four weeks after notification has been received, the changes to the General Data Protection Terms are deemed to be accepted. In our notification we will specifically inform you of the significance of this four week time limit.

In the tree view that is displayed there is an option in the "Cookies" section to "Allow cookies that are stored on your computer" and "Allow per-session cookies (not stored)". In both cases the value must be set to "Disable"

In Internet Explorer versions 5.0 und 5.5 cookies can only be switched on or off. This configuration applies to all sites visited. If you disable cookies you might experience problems on other websites, which require cookies in order to function. If this is inconvenient to you we recommend a/an (free) upgrade to Internet Explorer version 6, as cookies can be also switched off for individual sites.

Please note that the Special Data Protection Terms only apply to individuals who give explicit consent while registering for a service. The General Data Protection Terms also apply. In case of any contradiction between the General Data Protection Terms and the Special Data Protection Terms, the provisions of Special Data Protection Terms prevail.

Collection, processing and use of personal data

When you register on our site, we will request some mandatory information, and where applicable, some voluntary information (hereinafter jointly referred to as "registration data").

In order to provide you with offers and information we use your registration data as follows:

We contact you by post (e.g. with special product offers) and/or by e-mail (e.g. newsletters with interesting information from different companies belonging to the ProSiebenSat.1 Group and/or from our business partners) and via telephone and/or SMS/MMS - as long as you have agreed to it.

In order for us to provide you with information and offers that match your interests, your registration data is stored in our database, linked with one another, and evaluated. In addition we amend and update your registration data, or compare it with data from external sources if necessary.

Your registration data is also forwarded on to other companies in the ProSiebenSat.1 Group for the same purposes.

Collection, processing and use of usage data

Usage data is data that can be passively collected, e.g. while you are using a website, registering for a service, opening a newsletter or clicking a link.

In order to tailor our services to your interests, we collect, process and use the requisite usage data and your reactions to the information and offers sent to you (especially opening, clicking, requesting information material, purchasing) by using cookies and IP addresses on our websites and link tracking in our e-mail campaigns.

Forwarding of data

We do not forward your data to companies outside of the ProSiebenSat.1 Group, unless you have given your express consent for such forwarding of data to business partners or other third parties.

Right of revocation

Client

The term "Client" refers to a network computer [personal computer] that uses the network resources provided by a corresponding server [data, program etc.], or a program that uses services of another program.

IP addresses provide an address for devices accessing the internet. Every computer has a unique IP address in the form of a fixed series of numbers.

Link Tracking

The recording of a user's web surfing patterns.
